10.0      Offences and Penalties


Every person who fails to comply with the requirements of this Bylaw commits an offence under Section 239 of the Local Government Act, 2002, and is liable to enforcement action by the Council.  The type of enforcement action carried out by Council will depend on the severity of the situation and may include:
  1. Non-compliant notification to the land owner/occupier including a time period to rectify the issue.  If compliance is not reached within the specified time period of the notification, then Council will rectify or organise for the issue to be rectified, and recover all costs from the culprit and/or land owner/occupier in doing so; or
  2. Council rectifying or organising the rectification of the issue if the situation is creating nuisance or if that is the preference of the land owner/occupier, and all costs will be recovered from the culprit and/or land owner/occupier in doing so; or
  3. Prosecution;or
  4. Issuance of an infringement notice as specified in s. 245 of the Local  Government Act, 2002.
