Plan Change 47 - Zoning and Rule Provisions

Plan Change 47 reviews the parts of the District Plan relating to the planning rules and zoning for each of our three towns and the areas around them. From smaller section sizes to business zones, we want to ensure that the land supply is aligned to our population projections and that there is room for future growth.

The Process

The process for proposed plan change 47

Note: following a Note of Direction from the Chair of the Hearing Panel, the hearing of submissions for the Horrell Road Notice of Requirement and rezoning, and Kuranui Road rezoning was deferred until later in 2017. However, at its meeting on 13 December 2017 Council resolved to withdraw the Horrell Road Notice of Requirement and rezoning proposal. Please see below for details.

 

The changes approved by Plan Change 47 are wide ranging and affect the zoning and planning rules for Matamata, Morrinsville and Te Aroha. They include:

  • changes to the rules for building setback distances from boundaries
  • a review of residential zones
  • a review of the locations of rural-residential zones
  • identifying likely future urban growth areas
  • changes to residential infill subdivision around town centres
  • a review of shop frontage areas in town centres
  • a review of the development controls and subdivision rules
  • fewer requirements for landscaping in business and industrial zones.

Some town specific changes are also being considered. These include:

  • a review of the heritage rules and the extent of the Te Aroha Character Area.
  • a major review of the existing zoning for land between Station Road and Firth Street in Matamata (formerly referred to as Precinct F)
  • new industrial zoning for Morrinsville and Matamata
  • new business zoning for Matamata to allow certain businesses to operate in some existing residential areas.
  • new business zoning for Morrinsville
  • new residential zoning for Te Aroha
  • new rural-residential zoning for Morrinsville 

Status 

Notified inviting submissions from October  - December 2016
Notified inviting further submissions which closed on 1 March 2017
A hearing was held on 20 and 21 June 2017
The decision was notified on 13 September 2017. This excludes the Horrell Road Notice of Requirement and Kuranui Road rezoning*. 

An appeal to the Environment Court was received on 24 October 2017.

*Note: the provisions that relate to all parts of Plan Change 47 that are not subject to the Environment Court appeal can now be given full weighting. This excludes the Horrell Road Notice of Requirement and rezoning (which have both been withdrawn) as well as the proposed Kuranui Road rezoning. However, the extent of the residential rezoning and the proposed Future Residential Policy area north of Banks Road, Matamata is subject to appeal and limited weighting will be given to the new proposals of Plan Change 47 until the appeal is resolved.

Withdrawal of part of Plan Change

Withdrawal of Horrell Road rezoning and Notice of Requirement: At its meeting on 13 December 2017, Council resolved to withdraw the Horrell Road Notice of Requirement and rezoning proposal. This means that the proposed Horrell Road Rural-Residential rezoning will not proceed and the existing Rural zoning will remain. 

Part Decision

The decision excludes the Horrell Road Notice of Requirement and rezoning (which was withdrawn by Council on 13 December 2017) and Kuranui Road rezoning.

Horrell Road Morrinsville - Notice of Requirement (Appendix 1.5). This a notice of works to realign Horrell Road. It outlines a brief explanation of the project and the requirements that must be followed to ensure matters such as amenity and cultural values (noise, traffic, waahi tapu, etc) are taken into account during the works.   1. Take a look at the change maps for MatamataMorrinsville or Te Aroha (Appendix 2.1). Is your property, or any of the properties neighbouring you, included in an area that is proposed to undergo any changes?

  2. If the answer to the above question is 'yes': find out more about specific zoning changes (Appendix 1.1). 
    If the answer is 'no' or 'yes': there are general district wide provisions which may still affect you – such as maximum site coverage, residential infill housing, yard setbacks, and requirements for general residential subdivisions, see Appendix 1.1 (page 8 onwards) and Section 6 of the District Plan.
