The Gambling Act 2003 mandates that territorial authorities adopt a policy for Class 4 Gambling Venues. Although under the Racing Industry Act, territorial authorities must also establish a policy regarding TAB venues.​

Council approval is necessary for new premises and, in some cases, for increasing the number of machines at existing venues as part of the overall licensing process under the Gambling Act.​
